The consensual path is almost always faster, cheaper and less burdensome for the children than litigation. It is not, however, always feasible. A realistic assessment of what can be agreed out of court and what will necessarily be decided by the court is made from the outset, so that no time is lost in negotiations with no real prospect of success.
